Ukrainian Experience for EU Port Charging Policy journal article Oleg Milchenko European Procurement & Public Private Partnership Law Review, Volume 10 (2015), Issue 2, Page 102 - 110 The European Commission continues promoting the initiative of adoption of the so-called Port Services Regulation, which should provide the competitive and transparent framework for functioning of major ports across the EU. The initiative covers different aspects of port activities, including pricing for port services. Commission's proposals caused different reactions among commentators and stakeholders and faced strong opposition among UK ports. There is no doubt, the Commission tries to create "fair rules" for the overall port sector in the EU but such initiatives might include some features of centralisation (this is one of reasons why UK ports, which historically functioned as commercial entities rather than as public services providers, try to block the Regulation). On the other hand, Ukraine, despite severe political and social crisis, has been providing comprehensive port reform since 2012, and Ukrainian port reform is directed on decentralisation in regulation of provision of port services. Learning Ukrainian experience in port services regulation allows assessing advantages and disadvantages of the Port Services Regulation, especially in aspects regarding charging policy.
